Welcome to SunnyTops Treehouse. These Terms and Conditions constitute a legally binding agreement made between you ("Guest", "Client") and SunnyTops Treehouse ("we", "us", or "our"), concerning your access to and use of our property for overnight stays or events. By completing a booking, you acknowledge that you have read, understood, and agree to be bound by all of these terms.

1. Booking, Payments, and Security Deposit

All bookings are processed securely via Stripe. A full payment or a 50% non-refundable deposit is required to secure your date. We reserve the right to require a credit card on file or a separate Security Deposit prior to your event or stay to cover any potential damages, excessive cleaning fees, or violations of property rules.

2. Cancellation & Force Majeure

  • Standard Cancellations: Cancellations made 7 days or more prior to the event/check-in will receive a full refund (minus payment processing fees). Cancellations within 48 hours to 7 days receive a 50% refund. No refunds are issued for cancellations made less than 48 hours prior.
  • Force Majeure (Weather Policy): In the event of an official Hurricane Warning issued for Broward County that prevents the safe use of the property, guests may reschedule their booking to a mutually agreeable date within 6 months, or receive a full refund. Regular rain or inclement weather does not constitute grounds for a refund.

3. Property Rules and Event Guidelines

To preserve our ecosystem and respect our residential neighbors, the following rules are strictly enforced. Violation may result in immediate termination of the event without a refund.

  • Capacity Limits: Stays are strictly limited to 3 guests. Events must not exceed the pre-approved guest count (Maximum 50). Unapproved additional guests will incur extra fees or eviction.
  • Noise Ordinance: All amplified music and loud noise must be kept at a respectful volume and must completely conclude by 10:00 PM.
  • Decorations & Environmental Protection: The use of nails, staples, tape on painted surfaces, glitter, confetti, or balloons is strictly prohibited.
  • Smoking & Fires: Smoking is strictly prohibited inside the treehouse. Any smoking must occur in designated outdoor areas. Fires are only permitted in designated fire pits and must be supervised at all times.

4. Alcohol and Catering Policy

If alcohol is served during an event, the Client assumes all liability for the consumption and behavior of their guests. Underage drinking is strictly prohibited. All third-party vendors (caterers, bartenders) must be licensed, insured, and approved by SunnyTops prior to the event.

5. Indemnification and Hold Harmless

SunnyTops is an outdoor venue featuring natural terrain, elevated structures, and a pool. The Client and all guests assume all inherent risks associated with these elements. The Client agrees to indemnify, defend, and hold harmless SunnyTops Treehouse, its owners, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to personal injury, property damage, or any other loss sustained during the use of the property.
